I recently purchased a Hytera PD682G HT from Gerald Dubzak W2GLD. The radio was advertised as "Mint"Condition . When I received the radio although the radio was itself was clean it was missing 90% of the standard accessories that are always included when the radio was purchased new and always included when a radio is advertised as "Mint"

In my opinion the missing parts disqualifies the radio's status as "MINT CONDITION" especially since the seller didn't disclose.these missing items and his photos were taken in a manner where the missing parts could not be seen. One of the missing parts was the accessory cover.. With the absence of this one part alone the radio no longer meets the IP67 Protection spec regarding dust effects and immersion, NOT WHAT I PAID FOR

Secondly, he REFUSED to accept PayPal in the conventional manner, he would only accept with the "friends and family" provision. (another red flag)

Use extreme caution if you choose to deal with him

The above commentary is simply not accurate and I take attacks on my integrity very seriously... Here is the original sale ad that was posted here on QRZ.com: https://forums.qrz.com/index.php?thread ... st-4033078), the advertisement very clearly and explictly states what is included with the radio. The radio itself was in mint condition as stated, I took simple photos of the most valuable parts of the radio display for illustration purposes and posted the honest facts surrounding the radio itself. The ad in no way, shape or form indicates that this is a new radio, nor should the buyer have expected such as this is a forum for listed mostly used ham radio equipment. Secondly, the buyer purchased this radio on the advise of a friend; whom we both are acquainted with on the air. The buyer himself asked no questions about the radio prior to purchase, nor did he request any additional photos or information about the package; otherwise he would have been well aware of what he was getting; I hide nothing about my items and those of you on QRZ.com and other forums who've dealt with me in the past know the quality of my equipment as well as the detailed sales posting I list here. For the seller to indicate that I've been dishonest in some what surrounding this sale item is grossly untrue; because the seller has remorse for purchasing a radio, I am left to take the brunt of his attacks; up-to and including a public display of false accusations and a PayPal dispute that as frozen the monies from the sale of this item.

Now, some additional details the buyer left out. First, he received the radio and made no immediate comments to me in several emails regarding anything missing from the package. He received software and firmware updates for himself and his friends from me and even programming data to get the radio going on the air; still no commentary about missing items. Several days go past and then he casually asks me the origin of the radio, which I supply. A day later, an email follows as to why no manual was included (never said it was included in the original sale ad), then another day later the nasty emails begin followed by a PayPal dispute being filed. He never asked or attempted to work with me directly to resolve the issue. Fact, he never mentioned returning the radio for a refund; instead he is keeping the radio and trying to recover the money from the sale; where I come from that's called THEFT... Finally, yes, I requested PayPal payment to be sent via "Friends and Family" method just for this very reason. Unfortunately there are allot of dishonest people out here and this protects me from being ripped off by PayPal users who purchase things and then claim issues with them otherwise and then never return them or return them in a condition other than what they we're sent and I, as the seller, am left to pick up the pieces. As a result of this latest issue with Bill Lupo, WR2M; I will never use the PayPal payment system again; PERIOD. All sales transactions will need to be done via USPS Money Order.

The facts are simple here; I listed a radio for sale that was in-fact in "mint condition"; that doesn't mean it includes every accessory, box, manual, etc that came with the radio unless otherwise noted. Fact, the sale listing was VERY clear as to what was included in the sale of this item; plain and simple words "Included with this package is the radio, titanium antenna (which is an upgrade option), two OEM batteries, rapid desktop charger, and the USB programming/firmware cable. The radio is running the latest firmware release, A7.06.06.000 and will include the latest CPS software as well. I am a non-smoker and the radio us in mint condition, excellent audio, completely tuned/aligned less than six month ago"; if the seller has remorse for spending money on a used radio, then he should have ponied up and purchased a new one. Final fact, the radio was shipped exactly as advertised in the original sale listing; the buyer asked no further questions, did NOT request additional photos, or anything else of the sort; he simply agreed to send me my asking price, I immediately programmed the radio to suite his needs and shipped it to hims A.S.A.P. as agreed upon via USPS Priority Mail with full tracking information within 24 hours of the payment being made via PayPal. I kept my end of the deal, now Bill Lupo, WR2M wants to keep the radio and expects to get something for nothing; so when you discuss the details of being dishonest Bill, make sure you indicate all the details surrounding the issue at hand and the facts that you made zero attempts to return the radio; shame is, I would have been willing to work with you and if the missing piece of plastic (the accessory cover) was such a big deal, I would have ordered one and shipped it to you; now, because of your tactics, you are on your own and I will take whatever actions necessary to recover the costs of this transaction.

For the general readers of this post, if you would like to see all of the documentation, email correspondences, etc between myself and Bill Lupo, WR2M; I'd be more than happy to share them in "full transparency"; just send me an email and I will forward the information along. In the meantime, I am left to deal with PayPal and the law enforcement authorities to address this issue.

How can a radio be advertised as "Mint" when its missing key components, its like selling a car with 3 wheels or a race horse with 1 leg. .When a radio is advertised as "Mint" it implies "like new condition" and certainly no missing components and or pieces missing. Mint condition should be in the condition it was when shipped from the dealer, nothing more, nothing less..

PayPal was conceived to keep both parties honest and in this day and age its a very much needed resource. By requesting money as " friends and family" for a sale "in my opinion" is unethical and it demonstrates your lack of ethics especially since I am not your" friend "(thank God) and am certainly not your" family" either (thank God again) So much for your claim to integrity...As far as you not using PayPal again there is a good chance you've already violated their terms of service by abusing their Friends and Family policy and if there is justice hopefully they will close your account. .

Rest assured, if PayPal does decide in my favor you will get your treasured "Mint" condition radio back providing you send me the funds to cover the return shipping..

If you would like to save the return shipping money and cancel the sale in person I would be more than willing to meet you in person in a public place (since you are in NJ this week) shake hands and cancel this sale and both parties could move on...Your call

If you choose to cancel the sale in person I will bring my laptop with me and close out the PayPal claim right in front of you once I am refunded.

And no its not Buyers recourse, i just wanted a complete Mint radio..

Your tone in your emails is exactly why I wouldn't even consider meeting you, even-though, yes, I am in the state of New Jersey this week visiting family for the holidays. That said, if you wanted to return the radio, you should have indicated that prior to asking for the CPS software to program it and the firmware for you and your friends repository. In addition, you should have submitted a simple request to me directly before starting this charade with various online ham selling sites, PayPal, and on the air. That said, if you want a refund, you should send me a formal email, now CC'ing PayPal dispute team, the QRZ.com Classified Staff as well as the numerous other websites that you've decided to slander my name on over the past two days and then once I receive that, you have my address; I AM NOT PAYING FOR RETURN SHIPPING, YOU ARE, otherwise it's theft. At this point, I am happy to part ways with you, I will take the radio back, minus the shipping costs to you (I will provide the original shipping receipt so you know exactly how much it was) and when I have the radio in-hand and can inspect it to make sure it's exactly how it was shipped to you, I will happily refund your money (minus the aforementioned); this is a normal process of doing business in a civilized world. As for my advertisement of "mint condition", no assumptions should ever bad made, that's on you and you alone; you had several opportunities to ask questions, request additional details, and even refuse to use PayPal's Friends and Family payment method; which by the way you also violated their terms of service by agreeing to this transaction, so that leaves you in the same boat; you could have easily said no and there wouldn't even be an issue because I would have just moved on. So as it stands now, you are not a reputable buyer, you have made choices that have caused this public spectacle and now you expect me to go out of my way to work with you? Not hardly; if it comes down to it, expect one hell of a lawsuit against you for slandering my name and reputation in public; not to mention a possibly stolen radio if you don't return it if/when PayPal decides to resolve the issue. Rest assured, I will NOT take this kind of treatment from anyone; the ball is in your court now, you chose this path and now you have the power to correct the issue. The radio was sold as listed, nothing more and nothing less, your words. I am done with this public spectacle and I will be following up with the proper authorities moving forward. Again, to those in the amateur radio community, I apologize that you must bear witness to such issues, sad that this stuff happens, but some hams just aren't right; it's another reason I am one foot out the door.

Okay, it's gets even better now with this guy; last night at 21:32 ET, William Lupo, WR2M sent me the following email in response to my above post:
Gerald,
As per your post on qrz.com I accept your terms to return the radio back to you for a refund. As an effort to put this issue to rest I will also absorb the shipping expense in both directions.

If you still stand by this offer and wish to resolve our dispute I will prepare the radio for shipment and I request that you please confirm your shipping address. Prior to shipping I will take photographs of the radio to document that the condition of the radio is unchanged from when it was received from you.

In closing once you do confirm that we do have a solid agreement in place I will contact PayPal to advise them that both parties have come to an agreement. To reiterate our agreement is as follows;

You the seller will refund me the buyer $425 minus your "actual shipping" expense estimated to be at or around $10-20 which you agree to provide documentation for a refund at or around $410 plus or minus.

Also as per your request I have included the moderators from qth.com and qrz.com in this email to let them know that an agreement has been reached..I will await your response before I take any further action and once you confirm our agreement I will provide PayPal a copy of this correspondence so they can update their file

Around 23:00 ET last night, PayPal has decided the outcome on the case in my favor and the money was refunded; however, William Lupo allowed no time for me to respond to his request. Today, I see that he has listed the radio for sale here: https://forums.qrz.com/index.php?thread ... ht.545437/, which only leads me to believe this issue is resolved and this claim is false and as such this topic and all information regarding it should be removed from qth.com as it has no merit and tarnishes my otherwise positive reputation in the amateur radio community, otherwise he wouldn't have relisted the radio for sale without allowing me to respond. As far as I am concerned, based on William Lupo's (WR2M) actions; this issue is resolved and I am moving on.

To all the amateur radio operators out there that have seen this, please use extreme caution when buying or selling to anyone whether using PayPal, USPS Money Orders, etc. You never know who you are dealing with, but generally a quick set of email exchanges, a contact on-the-air, or even a good old fashion phone call can help ease the process. I apologize again for everyone having to see such negativity within our ranks and all we can do is move forward and enjoy the hobby.

Actually unlike Gerald I dont have hours on end to write lengthy post because I actually have to work for a living. This is only a hobby and it was no longer worth my time getting aggravated dealing with a seller that advertises with very vague ads at best. In the past few days many local hams were polled and all parties felt his photos and his description of the "Mint" description was not accurate at best.

Last night when when PayPal was still involved I was going to return the radio back to him since I was under the impression that I still had some " buyers protection" from what "I considered" a very misleading ad. But this morning when I read PayPal's decision stating "We are unable to take any action on this case because it is not covered under PayPal Purchase Protection." I was not surprised with the decision because the day I opened the dispute the PayPal a CSR told me from day one that this might happen because of the "Family and Friends"method of payment that was used for the sale but I was still advised to file the claim and to wait and see what happens.

So guess what, Gerald YOU WON I and I am sure your proud you got over on me.

This morning I decided it was time to cut my losses because this guy is not worth my time and energy to continue to fight a loosing battle with a person who IN MY OPINION speaks down to people and writes in a very demeaning and condescending manner. I decided to sell the radio because every time I look at the radio it reminds me of how I was taken advantage of BUT I have also decided to supplement the future buyer with some of the parts that Gerald did not include and that "I felt" I should have been included when purchasing a "mint" condition radio. (See attached a proposal from a Hytera dealer) . And unlike Gerald's ad my photos are extremely accurate depicting the "missing belt clip" and the "accessory port cover" because I dont want my buyers to have any surprises when they open the box. I also did not advertise the radio as MINT either....because its NOT !!!!

I have been licensed since 1988, I have bought and sold hundreds of items going back to the early days of the "YELLOW SWAP SHEETS" without incident, I also have a 100% Postive Feedback on Ebay,

As the saying goes "Life to Short, and I'm sure Gerald will twist my words around because he's good at that and I suspect that at some point in his life he must have taken a creative writing coarse.

In closing I've already wasted way too much time dealing with this professional.............. WHATEVER. Im done but Gerald Im sure you will keep the fire going because appears you thrive on attention , 73 .GOODBYE, I' M DONE... YOU WIN, I LOOSE
