WP4O - Bad experience

I purchased an Elecraft K2 from WP4O recently believing it was in mint condition as stated by the seller. After received the unit I found out the item was misrepresented and asked for a refund. The seller would not take it back. The item was paid via Paypal, and a dispute was filed. Paypal immediately ruled against my dispute, as they will only investigate if an item is not shipped.

Hi Niko its not even one year old assembled.. no pictures at this time but
its in mint shape..

….Next WP4O sent me two very large front pictures, one out of focus, the other good. We talked over the telephone. I questioned what appeared to be a scratch on the unit in one of the pictures. The seller replied it is not a scratch; there are no scratches on the radio….. We finalized the deal, he asked $25 for shipping from FL to CA (under 6 lbs)

My response upon receiving the radio:

I received the K2 yesterday. Upon inspection I noticed the ATU board was once installed and removed from the unit leaving marks on the case. The transverter board is missing the out jack. There is a scratch on the top of the unit. The frequency readout when compared to two of my FT1000MP radios is off by more than 1 KHz.

There was no mention of any of this in your description of the radio. There might be more, but at this point I see no sense in continuing inspecting the unit, as i am unsatisfied with the product.

I beleive the unit is significantly different than advertised. I would like to return the unit to you at my expense in the same condition as received for a refund.

You stated the unit to be in excellent condition with no scratches, or other problems known to you. I understand the ATU was not included in the sale, but you did not say it was installed and removed leaving marks. How about the missing connector for the transverter? There was no talk about returns, but also there was nothing stating the unit to be sold as-is in your ad. Clearly the unit is not in excellent condition. If you are a gentlemen you will take back the unit and refund the money. There is no cost to you. You will be receiving the unit back as it was when shipped.
