N2ZD Richard Russo - Buyer beware!!

On April 14, 2014 I agreed to purchase a Yaesu VX74 from Richard Russo (N2ZD) for $170 shipped. The add was listed on QTH under listing # 1125773. Here is the series of events that has transpired thus far, all of which I have emails attesting to.
- April 14, 2014: We agree on a price of $170 shipped.
- April 14, 2014: I send a PayPal payment of $170 to Richard Russo's email PayPal address
- April 14, 2014: Richard Russo emails me, confirming receipt of the payment, and saying that he will ship the 7R on Wednesday (4/16/14) and provide tracking information. He also indicates that if he is unable to ship it on Wednesday, then he will ship on Thursday (4/17/14)
- April 16, 2014: I email Richard Russo, asking if he has sent the 7R yet, and ask for a tracking number. No response received.
- April 17, 2014: I send a followup email, asking if the 7R has been sent yet, and request a tracking number.
- April 18, 2014:I receive a response from Richard Russo. He says that he didn't ship it out as promised earlier, because he located an additional accessory for the radio, and wanted to include it. He states that he will ship it out on Saturday April 19, 2014 and provide me with a tracking number at that time.
- April 19, 2014: I send an email to Richard Russo, asking for the tracking number that he had promised to provide. No response received.
- April 21, 2014: I send another email to Richard Russo, reminding him that he had promised to ship and provide a tracking number two days prior. No response received.
- April 23, 2014: I send an email to Richard Russo, telling him that it has been 5 days since I have heard from him, and again ask him to provide a tracking number for the radio he promised to send on April 19.
- April 23, 2014 at 7:40am PST: I receive an email from Richard Russo wherein he claims that he tested the radio before sending it only to determine that it had an issue with the UHF side of the radio, and that he would "be refunding your money shortly"
- April 23, 2014: I respond to Richard Russo's email, indicating that I would be monitoring my PayPal account, and would expect to see a refund during the day.
- April 23, 2014 at 5:48pm: I email Richard Russo, pointing out to him that it had been 9 hours since he claimed he would "be refunding your money shortly" and that I had not received a refund in my PayPal account. I inform Richard Russo that I will be escalating this to a paypal claim if a refund is not received within 24 hours.
If Richard Russo's previous representations were true, namely that he would 1) Ship this radio on Saturday, April 19, 2014 and 2) That he determined that the radio was defective prior to shipping it on Saturday, April 19, 2014, then Mr. Russo has known for 4 days that I was entitled to a refund.
Mr. Russo neglected to email me on the 19th to inform me that the radio was defective, and failed to inform me of such until April 23, 2014 despite my many emails to inquire about the status.
As of this point in time, I am without my $170 or a Yaesu 7R that I agreed to purchase.
