AA9JE John....Crazy Seller?

I just made John AA9JE a fair offer on an Illegal Stryker CB Radio he has for sale on QTH. My offer was fair as I intend to use it for a wheel chock for my truck (emergency brake is broken).

I was nice, and friendly when I made my offer. John replied with a very quick email that I said, "F you Steven, and kiss my F'in Donkey".

I really don't care for kissing critters, and realized that my offer may have been a bit low so I upped my offer $10 and he replied (obviously I cleaned this up), " F*&^ U IT IS HAMS LIKE U WAS THE REASON I GOT OUT OF HAM RADIO. SOME DAY U OLD F*&^%$G HAMS WILL DIE AND HAM RADIO WILL BE BETTER OFF. SO GO F*&^ YOURSELF"

My next email was not an offer but an admission that he had been a Ham far longer then I....to which he replied, " so i made a big mistake f*&^%r. someday u will die and this world will be a better place for all left."

So, my question is......Is this the type of seller we should buy from? Not me.....

I will admit that I poked him a little, and expected to get poked back. Through this whole email exchange, I was cordial and friendly. I did not expect to get such a violent and abusive reply.

AM I CRAZY?? NO

Well now here is my one and only short reply to this post. Yes, I might be crazy but why should someone care who does not even know me. First of all Steve Haysset out to upset me from his first email when he saw my post about my radio for sale. Steve stated he just wanted to upset me because hams like me were giving ham radio a bad name. I do not care what Steve or anyone things of me when they do not even know me at all. Based on the things Steve said to me in several emails I will not take that kind of crap from nobody! Steve would NOT back off with his emails. Steve set out to upset me so he could post his statement about me. This must make him feel good. In my eighteen years in ham radio I have helped several hams anyway I could. Steve, I hope you feel better now because you did not bother me one bit. I do not care what anyone thinks of me that does not even know me. Oh and by the way Steve, I sold my radio no problem at all and I got my asking price. I simply do not care what anyone thinks about me. If you do not like it just leave me alone! I am not going to take any crap from anyone!

Sincerely,
John Welch AA9JE

Do you understand what an "export radio" means? It means that the radio can only be exported out of the USA. It is illegal to purchase the radio in the USA and this type of radio is never allowed on the QTH.com classifieds.

Thanks for your cooperation.

EXPORT RADIOS SPLD ON QTH.COM

Hi Scott,, YES I understand what an export radio is no problem. The fact is I have seen these kind of radios listed and sold on qth.com. many many times. I have used your swap board since 1992. My point is why am I being singled out as a bad seller just because I listed a export radio for sale like many other hams and cbers have done in the past. I have received emails and phone calls from hams telling me that they have seen export radios for sale on your web page many times so why am i being singled his done in the t as the bad ham here. Scott I posted the radio for sale only because I have saw this done in the past. I did not think it was a problem. If you would like to talk to me about this matter here is my phone number. 1-217-463-3176. I respect the fact that you own this site and you can do what you want. I think you pick and choose who and what you allow to be posted. I simply do not care what people think of me. I did nothing wrong. I did the same thing as other hams have done on your web site and you did nothing about it.

Sincerely,
John Welch AA9JE

John,
My first email to you was:

The response is from:

Name: Steven Hays Sr
Callsign: KA9MOT
E-mail: kc0rey@gmail.com

The response is:

$20 plus shipping for your illegal CB.

Your response to that email was:

f*&^% you!!STEVEN kiss my f$%^&*g ass. <-----cleaned up by me.

You feel that you are the one who is being victimized? I say this single response makes you at the least, a Rude Seller and in my book, that makes you a Bad Seller.

If you'd like, I'd be happy to post the whole email chain......

OK, I understand now. So, you think it's OK to go 120 mph down the highway, because other people have done it without getting caught? That makes it right?

Please explain to me what is different about the above scenario and what you did?

You knew it was wrong. You specifically stated the radio was "export only" and then you said you would only sell to someone in the "lower 48".

But you place the ad anyway... why? Because you've seen that others did it and didn't get caught?

Please understand that when you place an ad, it is IMMEDIATELY viewable. We have volunteers that take their time to look at the ads and if they find a bad ad, they remove it. Sure, it's possible you saw an illegal radio on the site for a few hours, or maybe even a day, or longer, if we didn't catch it.

The fact is that we don't allow them, and we apply the rules fairly to everyone.

Please abide by our rules, which are clearly listed on the "Place an Ad" page. This includes not posting radios that are not legal for sale in the USA.

Come on Bill, you know the answer to that. Anyway, This isn't about the radio. For me, it is about the attitude of the seller when I made an offer on the radio that he didn't like.

Also it appears that selling such a rig on QTH is not appropriate and is against the Terms of Service. (I know another site that used to have the same policy)

That would make the seller a Bad Seller....Bad attitude and won't follow the rules.

Maybe you should clean up the trash in your own neighborhood Bill.

Here you have an Export radio that the seller admits won't work on 10M. He sold one and claims he has 2 more.....

selling ILLEGAL cb radios is bad mmmkay

maybe the FCC needs to be contacted and a 10,000 dollar fine needs to be issued for selling illegal cb's

That Other Site!

That other site really does have different sets of rules for certain people, and yet another set for the moderators also. Right Bill?

Bill believes that this radio is not illegal.

The FCC sent me a few years ago, the following information:
Moreover, the dual use CB and amateur radios of the kind at issue here may not be certified under the Commission’s rules. Section 95.655(a) states: "….([CB] Transmitters with frequency capability for the Amateur Radio Services … will not be certificated.)" See also Amendment of Part 95, Subpart E, Technical Regulations in the Personal Radio Services Rules, FCC 88-256, 1888 WL 488084 (August 17, 1988). This clarification was added to explicitly foreclose the possibility of certification of dual use CB and amateur radios, see id, and thereby deter use by CB operators of frequencies allocated for amateur radio use.
The fact is that whether these CBs (that become "ham" transmitters aka freebanders, with a clip of a diode or resister) are legal or illegal, are garbage and are not welcome on the QTH.com Classifieds.

Out of band mods

Hi Scott and the rest,

Please do not mistake my observations for sarcasm as I really have wondered about the reverse scenario:

Type accepted Amateur radios that are just as easily operated on the Citizen's Band with the same simple surgery (with a clip of a diode or resister). It seems there is a plethora of radios for sale with the MARS mod yet I have never actually purchased one of these transmitters from an operator that was authorized to use the Military Auxiliary Radio System. So it has always appeared to me to be a sort of "nudge, nudge, wink, wink" disclaimer. In either case it boils down to a modification and subsequent potential misuse of the transceiver so the end result is equal in offense (except of course in the case of an actual emergency) . In any case, with little to no exception, the radio manufacturers, both large and small, have made it clear that they are not interested in circumventing the use of their Amateur radios on the Citizen's Band. Just one hour on YouTube will reveal an abundance of high end gear on CB frequencies.

I guess you could compare it to this applied logic: If you were to go from 0 to 55 in 5 seconds on a country road you might get a ticket for reckless op, but if you went from 55 to 0 in the same amount of time there is most likely no ordinance to disallow such behavior.

Thanks for reading, it makes me feel important!

If this website is under someone's responsibility, they can remove or allow whatever they desire. However, this issue seems pretty well defined already.

There are of course, other websites by which to post if unacceptable here. Simple matter of choice.

This thread is amazing. it is a simple case of someone selling against the terms.
A rude reply is a rude reply, plain and simple. the CB is illegal to be sold in the US. A mars modified amateur radio is different than an modified CB as it is modified for part of amateur radio. A ham should know better than to go out of band or use frequencies outside their license class. An Illegal CB'er will use it where ever they want when they want as the odds of them being caught is slim to none. the modified CB's are pieces of trash with crappy filtering and mess up the bands.

I get your point, Dave. It overlooks at least one legitimate reason to modify a radio, however---- 60 Meters. I hate to be lumped in with freebanders, pirates, and other outlaws for having performed the modification on my own radio (Yaesu FT-920), to gain access to frequencies I am allowed to use. Fortunately the modification is easily reversible if the rig were to be sold. 8)
