KC9LUT Ham Operators should not be this way !!!!

Purchased a FT 8500 from Eric Keck KC9LUT in early October on QTH.com classifieds and I am very disappointed to say the least....
The radio was $180 and I was charged $30 for shipping that should have only cost $15 at most.
The radio was missing the mobile mount, the power cord and the owners manual when it arrived.
Contacted the seller by email and phone calls numerous times; the items were promised several times and never mailed.
After fabricating a power cord the radio was tested and only transmitted 25W at full power and the receive was weak.
Attempted to contact the seller and he would not return emails and the phone number he provided to QTH was no longer receiving messages.
Since contacting the seller accomplished nothing; I filed a case with PAYPAL and American Express in early December.
AE and PAYPAL provided a phone number and confirmed address to contact the PAYPAL account owner used in the transaction.
The radio was returned to the confirmed address and American Express refunded the portion of the transaction they were involved with.
The seller has had the radio in his possession since the 2nd week of January and has been very evasive with refunding the remainder of the money...
Just contacted him again and during the conversation; I was hung up on....

This is not the type of transaction I would expect from a fellow Ham Operator.

I'm curious as to why you returned the radio. What am i missing here. Did he tell you he would only refund the money if you returned the radio? Not making a judgment but am just like i asked as to why the return of the radio.

Usually when you file a claim for goods received not as described with a credit card company or even paypal for that matter they want you to return the goods to the seller before thay will pay your claim.

I learned that about paypal as well. They only help with claims if you bought via scam bay...

In the future I will tell them the item was never received ! They want to play games now that I know how they treat paying customers.

I was told they only take action if the transaction was fraudulent or never
received..

No wonder folks dont like using paypal, you dont get anything for your money if there are issues...oh unless you bought it on scam bay..give me a break !!

You would have to say the transaction was fraudulent or you did not receive the goods.

Over the past several years I have purchased several radios from QTH Ham Operators.
I understand that radios can have problems after operating them for a while, but keeping the power supply cord and the operating manual makes me suspect he knew there was a problem which was not divulged....

This was not the kind of transaction I would expect from a Ham Radio Operator.

Well all i can say is i bought into a scam for a radio for sale on QTH and paid through Pay Pal. The other Ham whose call was used by the scammer called Pay Pal security and complained and i did also and my Money was refunded while i was still on the Phone with Pay Pal security. So to say they will only make it right if it is done through e bay is definitely not the case on my transaction. All this happened within the last two weeks and i reported the scam on here so your free to verify my statements. I can give you the Pay Pal security number if you like...

Well I received $103 credit from AE of the original $180 purchase price and the remainder will probably never be refunded...
Will be placing this transaction in the LIFE EXPERIENCES file and learn from it....

If I can stop other Ham Operators from going thru this; then it will be money well spent.

some hams i have found that they are very in patient and rude the bracket was shipped as far as the manual goes it was email because what i had was a printed copy. this guy that wants to bad mouth and badger me should really learn patience and not be so rude he never asked to ship the radio back there was nothing wrong with it so for all those people that want to judge me should really look at the issue here as far as his money goes the radio was sold as is like anything else electronic he was inform that i forgot the bracket agreed to ship it as soon as i could so why should i be the bad guy. right or wrong.

Charles, you come here complaining about your situation with this deal by slamming eBay ?

"scambay" ? You got "scammed" somewhere other than eBay ! If you had made the purchase VIA eBay it is very likely Paypal would have been returned your money already. I wonder if you filed a claim with Paypal before the American Express claim and BEFORE you returned the goods ?
I have known of Paypal to return funds outside of eBay often but they need some copy of the advertised condition to verify that the seller indeed shortchanged the buyer. Paypal needs evidence of "fraud" and they have an agreed procedure to be followed.Otherwise the seller can just fall back on the old "as-is" .



eBay has published rules and restrictions, agreed to by all participants. Paypal and eBay can enforce for both sides. Many other online sites have no such rules nor signed agreements between the two parties involved.

Paypal is a fine resource used by millions of people daily. Others and myself use Paypal to help fund this site with voluntary contributions from time to time. No plan is perfect but most of them have rules and procedures to follow. Reading the agreement when you sign up is a good place to start.

Payment Method Rights and Remedies

PayPal offers the following protection programs that apply regardless of the payment method:

PayPal Buyer Protection (for eligible items purchased on eBay)
PayPal will cover you for the full amount of the item plus original shipping costs, if you do not receive the item, or if you receive an item but it is significantly different than the description in the eBay listing.
To receive reimbursement for items that are significantly not as described, you will be required to return the item to the seller, or in some cases to PayPal, and to pay the return shipping costs.

eric, where do you come up with this nonsense? all of the honest sellers on qth guarantee their equipment to arrive alive. you shipped a rig missing the mobile bracket, power cord, manual and the rig was electrically trashed. you are dishonest and think about this....... you successfully dumped a broken rig on a fellow ham who trusted you. you got a quick $200. you will never be able to sell anything again on the internet classifieds with this feedback. you have managed ,in one transaction, to make some "chump change" and permanently destroyed your ability to sell on the internet. where do you get the idea that "all electronic equipment is "AS IS" ? WOW are you way off the beaten path..... the best thing you can do is send him 100% of his money back and that will begin to reestablish your reputation. of course you can be intransigent, keep his $$, and wonder why no one answers your ads in the future. this feedback is permanent.

the sad part is if he was anyttype of ham operator then he would have tested the radio you can still power the radio on with out the extention as far as the bracket goes it was sent out a week before he sent the radio back the stupid part to all this is this one conflict does not mean squat i have sold numerous things all over the web i dont scam people and never will there was things going on in my life at the time wich cause a delay in thing it is not my fault charles was impatient and figured he would be rude to my wife i never hung up on him this little forum is just so people like charles can wine a true ham has patience with his fellow hams instead of badgering them in a forum that most people could care less about he had no reason to send the radio back at all bottom line is people want to judge me thats fine because i dont care i should have never dealt with him i figured he would cause issues. if anything i would recommend not to deal with him because he is rude and inpatient

Eric you seem to imply no one really cares what is said about you or other Hams on this site and your wrong. When ever i see something advertised for sale or trade by another Ham i'm not familiar with the first place i come is here to see what others have to say about him or her.
As far as the buyers impatience to that i can not speak to other than if he had gotten what he paid for at the beginning impatience would have been non issue.

Eric, you have your stuff back, return the difference and all is well. Your problems are just that,they should not cost other people honest money. He knew nothing about you other than you had his money and he was being short-changed. Scammers are loaded with excuses, unfortunately honest people with real, meaningful issues have been lumped in with the scammers so their credibility suffers.

The real distinction is that people with character and class always make the deal right.This means a good faith refund. He held up his end of the deal the moment you were paid. You failed when the goods were incomplete or not as stated. Falling back on excuses and refusing to issue a full refund are just lame excuses. They are not rational reasonable cause for witholding monies that are owed.

Eric, do the right thing.

Hand Held extra now that one will have to be better explained for the Ham World use of a described operator. Notice you waited till the end of this to throw your comments out i guess you could not control your self any longer??? I'm certain the three your referring to is not the reason. After all making a day is not all that easy with you here to challenge it. But you made our day !!By the way if your referring to my asking Tran how his situation all turned out it just got moved,so try looking at the Free for all-anything related to ham radio.

larry, KS4ED took the side of the criminal who stole tran's money. it is no surprise that he now takes the side of another criminal and diverts this thread from recovering money for a ham who trusted a crook, to the "it's all about ks4ed"

WOW! What brought that on?

Everything these guys said is correct. Erick need to return the money.

I buy and sell allot of stuff here and on other radio websites. I'll not be buying anything from KC9LUT or KS4ED! They both sound like crooks.

I also never buy from anybody who uses the standard eBay cop out (As with all electronics). I guarantee my stuff will be as described and expect the same from the folks I buy from.

I've never been burned.

the phrase "As with all electronics", is only part of the saying. the entire phrase reads, "as with all electronics sold by weasels, crooks, con-men, flimflam artists, low life hillbillies who give you the old"tail light guarantee", and flea market dumpster divers, the rig will arrived dead or on life support". it is followed with "i told you it lit up when i turned it on, you probably opened it up and broke it. too bad, its yours now.....

Paul your correct about KS4ED as i recall his support for Mr. Cornell . And Steve Ka9mot is also right on. I have never understood how some one could cheat another over insignificant amounts let alone any amount. I recall being chastised by some for refunding a buyers money after i gave him permission to open up a radio he bought from me in order so he could maybe figure out why the radio was not working as i claimed it did. Like i said then and i'll say now that i sold in all honesty a good radio but between me boxing it up and his receiving it the radio died. My reputation was worth more than the lousy and mind you i'm far from financially being well off $125.00 i received for the radio.I'd rather eat beans and live in my car than be known as a dishonest trader..

Sounds like Eric made your day not our's .You were the one waiting for who knows how long to make your "statement". A lot of pent up anger ?

People gave some honest opinions on how this could be handled. You were the one who seized the moment. Not by simply offering and supporting an opposing view. You chose to take the opportunity to attack people who were commenting on the actual subject of the thread. It seems one possible motivation could have been"Extra Envy". Since you claim no support for Eric, there is little other reason for bringing up license class in this discussion. .That, perhaps being your style for "whining" .You used license class as a common element of your targeted group. Very revealing. No problem with divergent opinions here,but hijacking a thread over the license class of the people commenting ?

If this sounds like "whining"or "childish remark" to you, I could only suggest re-reading your own posts. Your negative commentary regarding the people involved could easily become taken or mistaken as a defense of Eric's behaviour. Well written responses are far less ambiguous.

Eric was here for you. You have revealed your probable motivation.Back to the subject at hand.
