If that isn't a BIG RED FLAG I don't know what is.
It is an often used eBay tactic for dumping non working equipment.
No matter what else the guy says he can send you a lightning gutted radio and point back to this little statement.

Not true! I sold a working Icom on eBay to a fellow who before he tested the radio replaced a cracked SO-239 connector on the rig. The connector posed no issue to the radio or its performance but it did not look that nice. Guess what? It did not work after that. I sold it with a warranty as I do everything but what am I supposed to do now? Selling something that you can document works and was functional as described when it left and to sell that item as-is is more than acceptable. I video the radio or item fully working the day it is boxed. I use my service monitor to verify the radio is working and take many pictures at the same time. I put the radio on th air and show that it is functional and to specification before it is sent.

I have no control over what someone does to the radio when it leaves my shack. I sell only my gear (generally) so I know it works. If I sell something for someone else I fully test the radio or item before I would think of listing it. I might change my mind on a warranty or return policy as who know what someone will do once they get the radio. Not everyone is out to screw you. On the other hand, there or others who might try to screw the seller.

Just to add to this i recently sold a radio with no warranty offered and believing it was in top condition when sold. The buyer when he recieved the radio said there was no transmit and i immediately refunded his money, as when i checked radio before shipping it was transmitting and even tho there was a implied where is as is i still felt the buyer deserved what i claimed and when it arrived as stated earlier i felt it was my place to honor my claim.The Radio was returned and performed as the buyer claimed. There are those who of course would have accused the buyer of tampering with the radio and then reminded them of the where is as is statement.I just feel my word is worth more than a few dollar's.....

So why dont you just say in your ad that you guarantee the radio to be working?

Saying the radio is "sold as is" and then refunding money is the same as selling it with a warranty and then not refunding money.
It is doing the opposite of what you say you will do.
Do you think I would want to deal with someone that does the opposite of what he says?

How do you know he did not do anything to the radio that may have damaged it? If it worked before it left and you can prove that why would you give the buyer his money back?

I understand WHY you did it and I probably would have also. I offered to look at or fix or return the Icom I sold to the fellow on eBay (see above). I offered a return policy with the understanding the buyer would not open the radio or otherwise damage the rig. I still stepped-up and made that offer. It could cost me the purchase of a military radio I wanted.

I guess my point is simple - if the radio worked when it left and you can prove that - how do you know what the other fellow did to the rig? I guess you are screwed either way. If you do not refund the purchase you will get slammed and if you offer to accept the radio back you are out the money to repair a functional radio when it left.

Look i was not looking for a sarcastic response and it appears you do not like being disagreed with and neither do i but such is life. Now as to your claim of double talk in my case i can only state that i advertised radio as working with no guarantee. I have no idea why you seem so disgruntled and bitter and maybe your not that way. But no matter what and i am by no mean's financially well off, i'd rather feel and know i did the right thing as i do try to live by the golden rule.......

The problem comes when you get outright liars. And they are getting plentiful, not to mention just plain nutty /deranged hams out there. They hate us sometime just because we do the right thing and tell on those who dont...2 cents is all I wanted but Ill alway take your word...even if you mess up and it happens to all of us, I know you will make it right...73 Murray PS Ive got some whack jobs emailing me direct now just spammin, but I do know who all of them are and will post them on my blog so you can see whos 'loose'..

Murray i for one will not allow my principles to be lowered for thirty pieces of silver and i know you are no different. But i wonder if all these crazies and con Ham's were brought out but because of the internet as it sure seem's like in the last couple of year's they have gotten worse..........

'it lights up" "no way to test it" "AS IS BUT NOT DOA" "selling for a friend who doesnt have internet" lots of low rent ways for the seller to have a clean conscience when he sells a known pile-o-junk. if you buy from someone who lists any of these red flags, be aware that you are going to get a rusty corroded non working pile of junk.
everything i sell comes with my personal guarantee that it works or i will make it right. my reputation as an honest ham is worth more than one shabby deal. i am amazed at the number of hams who think they can get away with "dumping" a $1000 rig on someone to make a few "quick" bucks. its a shame they are to stupid to realize that the one deal just shut them down permanently.

Add to the preceding "ESTATE SALE" or "SELLING THIS FOR THE FAMILY OF A SILENT KEY".

A decedent's family has NO LEGAL AUTHORITY to dispose of his gear until they have ALL APPLICABLE PROBATE or ESTATE PROCEDURES.

You may end-up buying something that the seller had NO RIGHT to sell or DIDN'T HAVE OWNERSHIP OF!

And, today, "ESTATE simply means "USED" or "PRE-OWNED".

Does the concept: As-Is Described ring true with anyone?

I may list this way and it means EXACTLY what it says and I stand behind that.

It does not have to imply that it is yours and tough luck if not as described.
All is not Black and White every time,not every Ham is trying to screw all the others and not any Ham is pure and true all of the time.

Many of us do the best we can and sometimes things happen.

I simply state the condition as clearly as I can and know and stand behind that.
If someone tries to say I made other claims it is sort of hard to argue but I would rather do the right thing hoping the same will come my way.

I also insist on a phone call before dealing with anyone. I can usually spot trouble with a few minutes on the phone first and my instincts tell me to steer clear of anyone not understanding this.

Just how I do it.
